General

The present website www.elivanhealth.com (hereinafter the “Website”) is owned by the company under the name “ELIVAN SINGLE-MEMBER PRIVATE COMPANY (IKE)”, having its registered office at 47 Alexandrias Street, Thessaloniki, Greece, with VAT No. 801790877 and G.E.MI. No. 163384006000 (hereinafter “ELIVAN”), and constitutes ELIVAN’s online store.

The use of the electronic pages and services of the Website and the online store by the user presupposes the unconditional acceptance of these Terms of Use, which apply to all content, pages, graphics, images, photographs, and files included on the Website (hereinafter collectively referred to as the “Terms of Use”). Therefore, the user must carefully read these Terms of Use before using the Website’s services and, if they do not agree, must refrain from using the Website and its content.

The Terms of Use are governed by Greek law, in particular provisions concerning consumer protection, electronic commerce, personal data protection, and intellectual and industrial property rights, as applicable.

ELIVAN reserves the right to unilaterally amend the Terms of Use or any part thereof at any time without prior notice. The current version will always be posted on the Website. Users are encouraged to periodically review these pages for any changes. Continued use of the Website and/or its services following any amendments constitutes unconditional acceptance of the revised Terms of Use.

Intellectual Property Rights

All content of the Website (including indicatively texts, images, photographs, graphics, designs, applications, files, and website structure) constitutes the intellectual (copyright and industrial) property of ELIVAN and is protected under applicable intellectual property laws, or may constitute intellectual property of third parties for which ELIVAN has obtained the necessary licenses exclusively for Website operation.

Use of the Website

The Website is intended exclusively for private individuals and is not addressed to businesses or wholesale customers. ELIVAN permits only personal, non-commercial use of the Website content for informational purposes. Use within a business, service, or organization does not constitute private use.

The Website must be used solely for lawful purposes and in a manner that does not restrict or impede its use by others. Users must comply with Greek, European, and international law and use the Website in accordance with the law, good morals, and these Terms of Use. Users are responsible for any damage caused to ELIVAN or third parties due to unlawful or improper use of the Website.

It is strictly prohibited to store, reproduce, republish, transmit, or distribute any part of the Website’s content for commercial purposes or any use not permitted herein.

It is also strictly prohibited to reproduce, store, or distribute registered trademarks or service marks of ELIVAN or its partners displayed on the Website.

Products

The purchase and sale of products available on the Website are governed by these Terms of Use and the Privacy Policy.

Subject to specific provisions herein, all product-related information, including availability, features, and specifications, is provided on the respective product pages.

Our products comply with strict quality control standards and are suitable for use in accordance with applicable national legislation.

Product Purchases

To purchase a product, select the desired product and quantity and click “Cart.” Products marked “Unavailable” cannot be added to the cart.

All displayed prices include VAT (where applicable) but exclude shipping costs. The total order amount, including VAT, is displayed in the cart.

After completing your selections, click “Checkout,” follow the payment instructions, and then click “Submit” to place your order.

By submitting your order, you make an offer to ELIVAN to conclude a sales contract for the selected products.

Product availability shown on the Website may not always reflect actual availability due to technical reasons. ELIVAN reserves the right to verify availability after order submission and will inform you promptly if any products are unavailable or if price changes occur.

If the entire order cannot be fulfilled, you will be notified and refunded in full if payment has already been made.

If no notification is received within 48 hours of order submission, your offer is deemed accepted, and a confirmation email will be sent, forming a legally binding sales contract.

Order changes or cancellations are accepted only before order confirmation. ELIVAN reserves the right to cancel orders due to product unavailability.

Payment

ELIVAN accepts payments by card or cash on delivery.

If payment is not completed, the order will not be delivered. ELIVAN does not have access to your payment card or bank details.

If payment is not received for any reason, ELIVAN reserves the right not to execute the order. You are also responsible for any collection costs for overdue payments.

Delivery and Shipping

Orders are shipped via ACS Courier to the address provided and in any case within 30 days.

Orders are processed and shipped on business days only (Monday–Friday). Shipping costs are displayed at checkout.

If the courier cannot locate you, you will receive a notification. If delivery fails after repeated attempts, the products will be returned to ELIVAN, and you will be refunded minus shipping costs.

ELIVAN is not responsible for delays caused by force majeure or unforeseen circumstances.

Customers are responsible for ensuring products comply with import regulations of the destination country. Any costs arising from customs refusal, storage, return shipping, duties, or penalties are borne by the customer.

After-Sales Service

Returns

If you identify an error, missing item, or defective product, contact us at info@elivanhealth.com and provide your receipt number.

You may return products (in part or in full) within 14 days from shipment, without justification, provided they are unused, in original condition, with intact packaging and accessories.

Refunds will be issued using the same payment method after inspection. Return shipping costs are borne by the customer.

Returns are not accepted for:

  • Opened products

  • Opened packaging

  • Tampered safety seals

  • Missing original packaging

  • Missing purchase receipt

  • Products intended for immediate consumption

Applicable Law

These Terms and the Privacy Policy are governed by Greek law. Any dispute falls under the exclusive jurisdiction of the courts of Thessaloniki.

In accordance with Directive 2013/11/EU, consumers may use the EU Online Dispute Resolution platform:

Limitation of Liability

ELIVAN makes every effort to ensure accuracy of Website content but does not guarantee uninterrupted service or error-free information. Liability is limited to the refund of the purchase price. ELIVAN is not liable for indirect, incidental, or consequential damages to the extent permitted by law.
